1. Acceptance of Terms
By accessing and using Waypoint Budget ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Intellectual Property Rights
The Service and its original content, features, and functionality are and will remain the exclusive property of Waypoint Budget Inc. and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
Code Protection: All source code, algorithms, database schemas, and technical implementations are proprietary and confidential. Any attempt to reverse engineer, decompile, or extract our code is strictly prohibited and will result in immediate termination of your access and potential legal action.
Data Protection: All user data, financial information, and personal details are protected under Canadian privacy laws and our security protocols. Unauthorized access, scraping, or data extraction is strictly prohibited.
3. Prohibited Uses
You may not use our Service:
- For any unlawful purpose or to solicit others to perform unlawful acts
- To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
- To infringe upon or violate our intellectual property rights or the intellectual property rights of others
- To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
- To submit false or misleading information
- To upload or transmit viruses or any other type of malicious code
- To scrape, crawl, or extract data using automated means
- To attempt to gain unauthorized access to our systems or networks
- To use unauthorized bots, scrapers, or automated systems to access the Service in a way that exceeds normal human-interaction patterns. This does not restrict accessibility tools, password managers, browser extensions, screen readers, or other legitimate assistive technology, nor does it restrict your use of Money Coach, Waypoint Guide, or any other AI features we provide as part of the Service.
4. Security and Anti-Bot Measures
We implement various security measures to protect our Service and users:
- Rate limiting and request throttling
- CAPTCHA and bot detection systems
- IP address monitoring and blocking
- Encrypted data transmission and storage
- Regular security audits and updates
- Monitoring for suspicious activity patterns
Any attempt to circumvent these security measures will result in immediate account termination and potential legal action.
5. User Accounts
When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for all activities that occur under your account.
You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar, or obscene.
6. Privacy and Data Protection
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information when you use our Service. By using our Service, you agree to the collection and use of information in accordance with our Privacy Policy.
We comply with Canadian privacy laws including PIPEDA (Personal Information Protection and Electronic Documents Act), Quebec Law 25, and applicable US state privacy laws including CCPA/CPRA.
AI Chat Features - Local Storage
Important: Waypoint Budget's AI chat features (Money Coach and Waypoint Guide) store conversations exclusively in your browser's local storage.
- No server-side storage - Chat messages are not saved to our database or servers
- Device-specific data - Chat history exists only on the device/browser where you use it
- User responsibility - You are responsible for managing your chat history through your browser settings
- Data persistence - Clearing your browser data will permanently delete all chat history
- No backup or recovery - We cannot recover deleted chat history as it is not stored on our servers
- Third-party processing - Messages are sent through OpenRouter to Google's Gemini AI for processing but are not retained after response generation
By using AI chat features, you acknowledge and accept that chat history is stored locally on your device and that we have no access to or control over this data.
7. Subscription and Payment Terms
Waypoint Plus Subscription
- Pricing: $7.99 / month or $79.99 / year — same price in both CAD and USD (excluding taxes)
- Trial: New subscribers receive a 7-day free trial. You will not be charged until the trial ends. You can cancel during the trial to avoid any charge.
- Billing: Billed monthly or annually on the date you subscribe
- Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled before the next billing cycle. You authorize us to charge your stored payment method at the start of each renewal period.
- Cancellation: Cancel anytime from your Profile page → Subscription, in the same number of clicks as signing up (this satisfies California's"click-to-cancel" requirement and New York's automatic renewal disclosure law). Access to Plus features continues until the end of your current billing period.
- Renewal Reminder: For annual subscriptions, we will send a reminder email at least 15 days before the renewal date.
- No Refunds (with carve-outs below): Payments are non-refundable except as required by applicable law
- Payment Failures: If payment fails, your service may be downgraded to the free tier after the grace period
- Price Changes: We will notify you at least 30 days before any price changes. Continued use after notification constitutes acceptance of the new price.
Waypoint Pro Subscription
- Pricing: $12.99 / month or $129.99 / year — same price in both CAD and USD (excluding taxes)
- What's Included: Everything in Plus, plus expanded bank-connection slots, net worth tracking, registered account tracking (TFSA/RRSP for Canadian users; 401(k)/IRA for US users), and household budgeting.
- Trial, Billing, Auto-Renewal, Cancellation, Refunds, Price Changes: All identical to the Waypoint Plus terms above. Cancel anytime from Profile → Subscription.
- Upgrades and Downgrades: You can upgrade from Plus to Pro at any time; the upgrade is prorated by Stripe and takes effect immediately. Downgrades take effect at the end of your current billing period.
Refund Carve-Outs
- Quebec residents retain all rights under the Quebec Consumer Protection Act, including any applicable refund rights for distance contracts. Nothing in this Section limits those rights.
- Other consumer-protection laws: Statutory refund or cooling-off rights under your local consumer-protection law continue to apply where they cannot be waived by contract.
- All platforms route through Stripe: Whether you subscribe from the web, iOS, or Android app, payment is processed by Stripe on our behalf (see “Platform Billing” below). Refund requests are handled by Waypoint Budget Inc. — contact support@waypointbudget.com. Apple and Google do not process Waypoint subscriptions and cannot issue refunds for them.
Platform Billing (Web, iOS, Android)
How you pay depends on the platform you sign up from:
- Web: Payments are processed by Stripe directly on waypointbudget.com.
- iOS app: Payments are processed by Stripe via an app-to-web checkout link (Apple's external-link entitlement model). Waypoint Budget does not use Apple In-App Purchase.
- Android app: Payments are processed by Stripe via an app-to-web checkout link. Waypoint Budget does not use Google Play Billing.
In all three cases, your relationship for billing is with Waypoint Budget Inc. (via Stripe). Apple and Google do not process or hold your subscription payments for the Service.
Payment Processing
- Processor: All payments are processed securely by Stripe, Inc.
- Stripe Terms: Payments are subject to Stripe's Terms of Service and Privacy Policy
- Payment Data: Credit card details are stored securely by Stripe, not by Waypoint Budget. We never see or store your full payment information
- Security: All payment processing is PCI-DSS compliant
Taxes
Posted prices do not include applicable taxes or other service charges. Taxes (including GST/HST/PST for Canadian customers and state sales tax for US customers where applicable) will be added to your invoice at checkout and itemized on your receipt. Waypoint Budget Inc. is registered with the Canada Revenue Agency as a GST/HST collector (Business Number 705761963RT0001).
8. Bank Connection Services (Plaid & Flinks)
Optional Feature
Bank connections are optional and available on our paid plans (Waypoint Plus and Pro). You are not required to connect your bank to use the Service.
Our Providers
Waypoint Budget uses two third-party bank connectivity providers to maximize the number of financial institutions we can support:
Plaid Inc. — our primary bank connection provider, covering most US and many Canadian institutions.
- Direct to Plaid: When you connect your bank through Plaid, you provide your banking credentials directly to Plaid, not to Waypoint Budget
- Secure Storage: Plaid securely stores your credentials and connects to your bank on your behalf
- Third-Party Terms: Plaid connections are subject to Plaid's Terms of Service and Privacy Policy
- Our Access: We receive only transaction data (date, amount, merchant, category) and account/balance metadata from Plaid — we never see your banking credentials
Flinks Technology Inc. — our Canadian-focused provider, used as an alternate or backup for Canadian institutions that Plaid cannot reliably connect to.
- Direct to Flinks: When you connect a bank through Flinks, you provide your banking credentials directly to Flinks, not to Waypoint Budget
- Secure Storage: Flinks securely stores your credentials on Canadian infrastructure and connects to your bank on your behalf
- End-User Agreement: Flinks connections are governed by our Flinks End-User Agreement, which you accept before connecting
- Territory: Flinks is used only for Canadian financial institutions and is a Canadian company regulated under PIPEDA
- Our Access: We receive only account and transaction details from Flinks — we never see your banking credentials
Which Provider Is Used
You can choose which provider to use when connecting a bank. Plaid is offered first for most institutions; Flinks is available for Canadian institutions where Plaid connectivity is unreliable or unavailable. Each connected bank uses exactly one provider, and that provider is determined at the time of connection.
Data Syncing
- Transaction data is synced automatically (frequency varies by bank, institution, and provider)
- We store only transaction details (date, amount, description, category) and non-sensitive account metadata (name, type, last four digits of account number, balances) — we do not store credentials
- You can disconnect any bank at any time from the Banks or Profile page
- Disconnecting will stop new transaction syncing but will not delete historical data already imported
Your Responsibility
- You must maintain accurate banking credentials with the applicable provider
- Notify us immediately at support@waypointbudget.com if you suspect unauthorized access
- Review all synced transactions for accuracy and report discrepancies promptly
- Understand that reconnection may be required if your bank changes security settings or requires multi-factor authentication
Limitations
- We are not responsible for incorrect, delayed, or missing data from Plaid, Flinks, or your financial institution
- Some banks and credit unions may not be supported by either provider
- Connection errors may occur due to bank maintenance, security measures, or credential changes
- Data retrieved through either provider does not constitute an official record of your account held at the financial institution
- We do not guarantee uninterrupted access to bank connection features
9. AI-Powered Features
Waypoint Budget includes AI-powered features: Money Coach (AI Budget Coach for personalized financial analysis) and Waypoint Guide (in-app help assistant for navigating the app). Both features are powered by artificial intelligence and the following terms apply to all AI-generated content within the Service.
AI Identity Disclosure
You are interacting with AI, not a human. Money Coach and Waypoint Guide are automated AI systems. They do not involve human agents. No fiduciary, advisory, or professional relationship is established through their use.
Third-Party AI Processing
Important: AI features use Google's Gemini AI models, accessed through OpenRouter (an AI routing service), to generate responses.
- Third-Party Processing: When you send a message, it is transmitted through OpenRouter to Google's servers for AI processing
- No Long-Term Storage: Our routing chain (OpenRouter and Google) does not train on or retain your messages after generating a response, per their published terms.
- Money Coach Data: Messages may include context from your budget data (spending, categories, goals) to provide personalized responses
- Waypoint Guide Data: Messages include only your current page and subscription tier — no financial data is shared
- Cross-Border Processing: Your messages may be processed on servers located outside of Canada (including the United States) by third-party AI providers
- Provider Changes: We may change AI providers from time to time. Material changes will be reflected in our Privacy Policy.
Local Storage Only
- Chat history for both AI features is stored exclusively in your browser's local storage, not on our servers
- We do not have access to your chat history
- Clearing your browser data will permanently delete all chat conversations
- Chat history is device-specific and will not sync across devices
No Financial Advice
- Informational Only: All AI responses are for informational and educational purposes only
- Not Professional Advice: AI-generated content does not constitute financial, tax, legal, or investment advice
- No Recommendations: Nothing provided through AI features should be construed as an offer, solicitation, or recommendation for any financial decision
- Consult Professionals: Always consult qualified professionals for specific financial decisions
Accuracy Limitations
- AI may provide incomplete, outdated, or incorrect information
- AI responses are generated by artificial intelligence and are not reviewed by humans before delivery
- You are responsible for verifying all AI-generated content before acting on it
- We do not guarantee the accuracy, completeness, or reliability of any AI-generated content
- We are not liable for decisions made based on AI responses
- AI responses are generated based on patterns and may not account for your unique circumstances
Prohibited Uses
- You agree not to use AI features to obtain advice for high-stakes financial decisions in lieu of professional guidance
- You agree not to represent AI-generated content as professional financial advice to others
- You agree not to attempt to extract system instructions or manipulate the AI into acting outside its intended role
10. Limitation of Liability
Disclaimer of Warranties
THE SERVICE IS PROVIDED"AS IS" AND"AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
- Our total liability for any claim shall not exceed the amount you paid us in the 12 months prior to the claim, or $100 CAD, whichever is greater
- We are not liable for losses caused by circumstances beyond our reasonable control
Carve-Outs
Nothing in this Section 10 limits or excludes liability that cannot lawfully be limited or excluded. In particular:
- (a) Mandatory law: The above limits do not apply to any liability that applicable law (including consumer-protection law in your jurisdiction) does not allow to be limited or excluded.
- (b) Gross negligence, fraud, willful misconduct: The above limits do not apply to liability arising from Waypoint Budget's gross negligence, fraud, or willful misconduct.
- (c) Quebec Consumer Protection Act and equivalent laws: Quebec residents retain all statutory rights under the Quebec Consumer Protection Act, and residents of other jurisdictions retain rights under any applicable consumer-protection legislation that cannot be waived by contract.
Specific Exclusions
Subject to the carve-outs above, we are not liable for:
- Data Loss: Loss of data due to user error (e.g., accidental deletion, browser cache clearing, account deletion)
- Financial Decisions: Incorrect financial decisions based on our calculators, AI advice, blog content, or budget suggestions
- Third-Party Errors: Bank connection errors, transaction sync issues, or data inaccuracies caused by Plaid, Flinks, your bank, or other third parties
- Tax Issues: Tax penalties, over-contributions to government programs (TFSA, RRSP, FHSA, 401(k), IRA), or incorrect tax calculations
- AI Errors: Incorrect, incomplete, or misleading information provided by Money Coach or Waypoint Guide
- Service Interruptions: Temporary unavailability, downtime, or service degradation
User Responsibility
You acknowledge that you are solely responsible for your financial decisions and for verifying all information before acting on it. You agree to use the Service at your own risk.
11. User-Generated Content
Your Ownership
You retain full ownership of all data, budgets, transactions, financial goals, and files you upload, create, or import into the Service. Your financial information belongs to you.
Limited License to Us
By uploading or creating content in the Service, you grant us a limited, non-exclusive, royalty-free license to process, store, and display your content solely for the purpose of providing the Service to you. This license includes:
- Storing your data on our servers (hosted in Canada)
- Processing your data to provide budget analysis, insights, and recommendations
- Displaying your data back to you through the Service interface
- Creating backups for data recovery purposes
License Termination: This license terminates automatically when you delete your account. Your personal data is removed immediately from our active systems; any residual copies in our infrastructure provider's encrypted backups are purged on their standard retention schedule. See Privacy Policy Section 5 for details.
Important: We do not use your personal financial data for any purpose other than providing the Service to you. We do not sell, share, or use your financial information for advertising or marketing to third parties.
Your Responsibility
You are responsible for ensuring that:
- You have the right to upload and use any data you provide to the Service
- Your content does not violate any laws, regulations, or third-party rights
- You maintain accurate and up-to-date information in your account
- You back up important data as we are not liable for data loss
Prohibited Content
You may not upload, create, or transmit content that:
- Violates any applicable laws or regulations
- Infringes intellectual property rights of others
- Contains malware, viruses, or other harmful code
- Is fraudulent, deceptive, or misleading
- Attempts to exploit or harm the Service or other users
Our Rights
We reserve the right to:
- Remove content that violates these Terms of Service
- Suspend or terminate accounts that repeatedly violate our policies
- Investigate suspected violations and cooperate with law enforcement if required
- Monitor usage patterns to detect fraudulent or abusive behavior
12. Intellectual Property Rights - Your Data vs. Our Platform
You Own Your Data
- Your financial data is yours: All budgets, transactions, goals, savings plans, and financial information you create remain your exclusive property
- No ownership claims: We claim no ownership of your personal financial information, data, or content
- Data portability: You can export your data at any time from your Profile page
- Deletion rights: You can delete your account and all associated data at any time
We Own the Platform
The Waypoint Budget platform, including all software, code, design, features, algorithms, user interface, trademarks, and branding, is our exclusive property and is protected by Canadian and international copyright, trademark, and intellectual property laws.
- Limited License: You receive a limited, non-exclusive, non-transferable, revocable license to use the Service for personal financial management only
- License Termination: This license terminates automatically when your account is closed or suspended
- No Transfer: You may not transfer, sublicense, or assign your license to anyone else
Restrictions
You may not:
- Copy, modify, distribute, or reverse engineer our software, code, or platform
- Create derivative works based on our Service
- Remove, obscure, or alter any copyright, trademark, or proprietary notices
- Use our trademarks, logos, or branding without prior written permission
- Attempt to extract or access our source code, algorithms, or database schemas
- Use the Service to build a competing product or service
- Scrape, crawl, or automatically extract data from the Service
Trademark Notice
"WAYPOINT BUDGET"™ and associated logos are common-law trademarks of Waypoint Budget Inc. (federal trademark registration with the Canadian Intellectual Property Office is in progress). Waypoint Budget Inc. asserts trademark rights in the WAYPOINT BUDGET mark based on use of the mark in commerce in Canada and the United States in connection with the Waypoint Budget app and waypointbudget.com website. All other trademarks, service marks, and trade names referenced in the Service, including financial institution names and logos (such as RBC, TD, BMO, Scotiabank, CIBC, Chase, Bank of America, and others), are the property of their respective owners.
The display of any third-party trademarks on the Service is for identification and informational purposes only, to indicate which institutions Waypoint Budget can connect to via our supported integrations. Waypoint Budget Inc. is not affiliated with, endorsed by, sponsored by, or otherwise associated with any financial institution or other third party whose trademarks appear on the Service unless explicitly stated.
13. Termination
Termination by You
You may terminate your account at any time by going to Profile → Manage → Security → Delete account, or by visiting waypointbudget.com/delete-account. See our Privacy Policy (Section 5) for what happens to your data upon deletion. Cancelling a paid subscription is a separate step (Profile → Subscription) — deleting your account also cancels any active subscription.
Termination by Us
We may terminate or suspend your account and bar access to the Service, with or without prior notice, for any reason — including a breach of these Terms, suspected fraud, abuse, or non-payment.
Refunds on Non-Breach Termination
If we terminate your paid subscription for reasons unrelated to your breach of these Terms (for example, if we discontinue the Service), we will refund you a pro-rata portion of any prepaid fees covering the period after termination. No refund is due where termination is for breach of these Terms, fraud, abuse, or chargeback activity.
14. Financial Information Disclaimer
Important: Waypoint Budget is a budgeting tool, not a financial advisory service.
- Not financial advice - All content, including blog articles, AI suggestions, budget recommendations, and financial calculators, is for informational and educational purposes only
- No professional relationship - Using our Service does not create a financial advisor-client relationship
- Consult professionals - Always consult with qualified financial advisors, tax professionals, or other appropriate experts for advice specific to your situation
- Information accuracy - While we strive for accuracy, financial rules, tax laws, contribution limits, and regulations change frequently. We do not guarantee the accuracy, completeness, or timeliness of any information
- Personal responsibility - You are solely responsible for your financial decisions. We are not liable for any losses or damages arising from your reliance on information provided through our Service
- No guarantees - Past performance, projections, or suggestions do not guarantee future results
By using our Service, you acknowledge that you understand these limitations and agree to seek professional advice for your specific financial needs.
Financial Calculators and Tools
Calculator Disclaimer: Our financial calculators (including but not limited to TFSA, RRSP, FHSA, tax, mortgage, retirement, and other calculators) are provided for educational and illustrative purposes only.
- Estimates only - Calculator results are estimates based on the information you provide and simplified assumptions. Actual results may vary significantly
- Not tax advice - Tax calculations are approximate and do not account for all credits, deductions, or individual circumstances. Do not use these for tax filing purposes
- Changing regulations - Tax brackets, contribution limits, and government program rules change annually. Information may be outdated
- Simplified models - Our calculators use simplified formulas and may not account for all factors affecting your specific situation
- Verify independently - Always verify important financial information with official government sources (CRA, provincial tax authorities, IRS, state tax authorities) or qualified professionals
- No liability - We accept no responsibility for any financial decisions made based on calculator results, including over-contributions, tax miscalculations, or investment losses
By using our calculators, you acknowledge that results are estimates only and agree to verify all information with appropriate professionals before making financial decisions.
15. Indemnification
You agree to indemnify, defend, and hold harmless Waypoint Budget Inc. and its owners, officers, directors, employees, contractors, agents, licensors, and suppliers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees and court costs) arising from or relating to:
- Your use or misuse of the Service
- Your violation of these Terms of Service
- Your violation of any rights of another person or entity
- Any financial decisions you make based on information from the Service
- Any incorrect data you input or import into the Service
- Your breach of any applicable laws or regulations
- Any content you upload, create, or transmit through the Service
Carve-outs: This indemnification obligation does not apply to (a) claims arising from Waypoint Budget's own gross negligence, fraud, or willful misconduct; (b) claims arising from Waypoint Budget's breach of these Terms; or (c) any obligation that cannot lawfully be imposed on you under your jurisdiction's consumer-protection law (including the Quebec Consumer Protection Act).
This indemnification obligation will survive the termination or expiration of these Terms and your use of the Service.
16. Severability
If any provision of these Terms of Service is found to be unenforceable, invalid, or illegal by a court of competent jurisdiction, such provision will be modified to the minimum extent necessary to make it enforceable, valid, and legal while preserving its intent to the greatest extent possible.
If such modification is not possible, the unenforceable, invalid, or illegal provision will be severed from these Terms, and the remaining provisions will continue in full force and effect. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision of these Terms.
17. Force Majeure
We shall not be liable for any failure or delay in performance of our obligations under these Terms due to circumstances beyond our reasonable control, including (without limitation) acts of God, natural disasters, war or civil unrest, pandemics, cyberattacks, infrastructure failures, or government action.
If a force majeure event continues for more than 30 consecutive days, either party may terminate these Terms upon written notice to the other party.
18. General Disclaimer
The information on this Service is provided on an"as is" basis. To the fullest extent permitted by law, this Company excludes all representations, warranties, conditions and terms relating to our Service and the use of this Service.
19. Governing Law
These Terms of Service shall be interpreted and governed by the laws of Canada and the Province of Alberta, without regard to its conflict of law provisions.
Any disputes arising from or relating to these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts located in Alberta, Canada.
You agree to submit to the personal jurisdiction of such courts and waive any objection to the venue or inconvenience of such courts. Nothing in this Section prevents a consumer in Quebec, California, or another jurisdiction with mandatory venue or governing-law rules from bringing a claim in their local courts where local law requires it.
19A. Informal Resolution & Class Action Waiver
Informal Resolution
Before filing any formal claim, you agree to first contact us at support@waypointbudget.com with a description of the issue. We agree to use good-faith efforts to resolve the dispute within 30 days of receipt. Either party may proceed with a formal claim after this 30-day period if the dispute is not resolved.
Class Action Waiver
To the extent permitted by applicable law, you and Waypoint Budget agree that each may bring claims against the other only in individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.
Carve-outs: This class-action waiver does not apply where it is prohibited by applicable law, including the Quebec Consumer Protection Act and any other consumer-protection statute that preserves a consumer's right to participate in a class proceeding. Quebec residents and other consumers in jurisdictions with non-waivable class-action rights retain those rights in full.
19B. Modifications to These Terms
We may update these Terms from time to time. We will update the"Last Updated" date at the top. For material changes (for example, changes that materially expand your obligations, reduce your rights, or change pricing structure), we will provide additional notice — at least 30 days in advance — via an in-app banner, email to the address associated with your account, or both, before the change takes effect. Your continued use of the Service after the effective date of the updated Terms constitutes acceptance.
19C. Responsible Disclosure (Security)
We welcome reports from security researchers who help us keep Waypoint Budget safe.
- How to report: Email team@waypointbudget.com with a clear description of the issue, steps to reproduce, and any supporting proof-of-concept.
- Acknowledgement: We will acknowledge your report within 72 hours.
